Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Ampluent (“we”, “us”) and govern your use of the Ampluent website and app (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

Eligibility and accounts

You must be at least 13 years old, and old enough to form a binding contract where you live, to use the Service. You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity under your account. Tell us promptly at hello@ampluent.com if you believe your account has been compromised.

Not financial advice

Ampluent calculates projections from the balances, budget lines, events, and settings you enter. Forecasts are estimates only. They do not account for everything that can affect your finances, such as interest, fees, taxes, investment returns, inflation, or changes in your income and expenses, unless you enter them yourself. Ampluent is not a bank, broker, or financial, tax, legal, or investment adviser, and nothing in the Service is a recommendation to take or avoid any financial action. Consult a qualified professional before making significant financial decisions.

Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• access or attempt to access another user’s account or data, or probe, scan, or test the Service’s security without our written permission;
• interfere with or disrupt the Service, including by sending automated requests at a volume that burdens it;
• copy, modify, reverse engineer, or resell the Service, except as permitted by law; or
• upload malicious code or content that infringes others’ rights.

Your data

You own the information you enter into the Service. You grant us a limited license to store, process, and display it solely to provide and improve the Service for you, as described in our Privacy Policy. You can delete your account and its data at any time from the Profile page.

Our intellectual property

The Service, including its software, design, text, graphics, and the Ampluent name and logo, is owned by us or our licensors and protected by intellectual property laws. Institution names and logos shown in the app belong to their respective owners and are used only to help you identify your accounts.

Changes to the Service

We may add, change, or remove features, and we may suspend or discontinue the Service. If we discontinue the Service, we will try to give you reasonable notice so you can record your information.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect the Service or other users. Sections that by their nature should survive termination, including the disclaimers and limitations of liability below, will survive.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that forecasts will be accurate.

Limitation of liability

To the fullest extent permitted by law, Ampluent and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, profits, data, or goodwill, arising from or related to your use of the Service or any decision you make based on a forecast. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim or US $50. Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you.

Indemnity

You agree to indemnify and hold Ampluent harmless from claims, losses, and expenses, including reasonable legal fees, arising from your misuse of the Service or violation of these Terms.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above and, for material changes, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
